These Terms and Conditions govern your use of the BAC Middle East website at www.bac.ae; www.bacme.ae; and www.bacme.com (“BAC Site”) and your relationship with BAC Middle East (“BAC Middle East”, “we” or “us”). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not use the BAC Site. If you are seeking to engage BAC Middle East for the provision of recruitment services, our standard terms of business will apply and a copy of these is available upon request.

Use of the BAC Site

We operate the BAC Site to assist you in understanding BAC Middle East’s services and in communicating with us. The BAC Site is provided for your personal use subject to these Terms and Conditions. By accessing or using the BAC Site, you agree to be bound by these Terms and Conditions.

You may not use the BAC Site for any of the following purposes: disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws; transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any applicable laws, regulations or code of practice; interfering with any other person’s use or enjoyment of the BAC Site; or making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner. By submitting information through the BAC Site you agree and acknowledge that while we may contact you in response to the information you provide, we are not obliged to provide you with any particular product or services.

BAC Middle East makes no representation or warranty in respect of any of the following: the existence or availability of any appointment advertised on the BAC Site; that any employer or client will ask for your CV, ask to interview you or recruit you; that any employer or client will keep confidential any of your information or data provided to that employer or client; or the final terms and duration of any appointment obtained through the BAC Site.

You are solely responsible for any information submitted by you to this site. You are responsible for ensuring that all information supplied by you is true, accurate, up-to-date and not misleading or likely to mislead or deceive and that it is not discriminatory, obscene, offensive, defamatory or otherwise illegal, unlawful or in breach of any applicable legislation, regulations, guidelines or codes of practice or the copyright, trade mark or other intellectual property rights of any person in any jurisdiction. You are also responsible for ensuring that all information, data and files are free of viruses or other routines or engines that may damage or interfere with any system or data prior to being submitted to this site. We reserve the right to accept, reject or delete any application supplied by you at our sole discretion, at any time and for any reason without being required to give any explanation. Upon receipt of an applicant’s full and accurate Curriculum Vitae, BAC Middle East shall, at its sole discretion, consider that applicant for suitable employment positions with its clients. BAC Middle East shall be under no obligation to find employment for the Applicant. By submitting information through the BAC Site, the Applicant consents to the retention of this information by BAC Middle East and the disclosure of all relevant and required information and documentation by BAC Middle East to the Client. The Applicant shall immediately notify BAC Middle East of any potential reason, circumstance or conflict of interest that would make their employment with the Client detrimental to the interests of BAC Middle East, the Client or the Applicant. The Applicant should not engage in any conduct which is detrimental to the interests of BAC Middle East, would negatively affect BAC Middle East’s relationship with the Client or is likely to bring BAC Middle East into disrepute. The Applicant undertakes to keep BAC Middle East informed of any direct communication with the Client, including but not limited to the provision of any offer of employment or engagement received from the Client. BAC Middle East is not responsible or liable for any loss suffered by the Applicant resulting from the actions of a Client, including but not limited to the cancellation of any offer of employment. Any Applicant having any complaint in connection with the recruitment services shall have the right to present a complaint in writing to a Senior Manager of BAC Middle East.

Availability of the BAC Site

Whilst we endeavour to ensure that the standard of the BAC Site remains high and to maintain the continuity of it, we cannot guarantee that the service will be fault-free. We do not accept any liability arising from any errors, omissions, interruptions or delays or any ongoing obligation or responsibility to operate this website (or any particular part of it) or to provide the service offered on this website. We may vary the specification of this site from time to time without notice. If a fault occurs in the service we will attempt to correct the fault as soon as we reasonably can.

Intellectual Property

The rights in material on this site are protected by international copyright, software and trademark laws and you agree to use this site in a way which does not infringe these rights. You may copy material on this site for your own private or domestic purposes, but no copying for any commercial or business use is permitted.

Applicable Law

The use of this website and any agreements entered into through this website are to be governed by and construed in accordance with the laws of the Dubai International Financial Centre. The courts of the Dubai International Financial Centre are to have exclusive jurisdiction to settle any dispute arising out of or in connection with the use of this website or any agreement made through this website.

You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected. If you breach these Terms and Conditions and BAC Middle East chooses to ignore this, BAC Middle East will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions. If any provision of these terms and conditions is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect. BAC Middle East shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.
